John Pappalardo achieves dismissal of criminal charges in forgery case
Pappalardo & Pappalardo succeeded in getting all criminal charges dismissed against their client in a forgery case on Wednesday, December 5, 2012, in the Eastchester Town Court.
John D. Pappalardo, managing partner of the firm, represented a woman charged with Criminal Possession of a Forged Instrument in the Second Degree and Offering a False Instrument for Filing in the First Degree. Criminal Possession of a Forged Instrument in the Second Degree is a class D non-violent felony, carrying a maximum of 2 1/3 to 7 years in prison as a first offense. Offering a False Instrument for Filing in the First Degree is a class E non-violent felony, carrying a maximum of 1 1/3 to 4 years in prison.
The Westchester County District Attorney’s Office had alleged that the woman possessed and submitted a forged Emergency Tenant Protection Act (ETPA) Renewal Lease Form to the Town of Eastchester Section 8 Office on May 3, 2012, in an attempt to apply for public housing funds. The form was allegedly doctored to alter the date of the form and the intended lease dates, as well as the addition of a tenant.
After a vigorous defense by John Pappalardo, the Westchester County District Attorney’s Office dismissed the criminal charges against the firm’s client on December 5, 2012, before the Hon. Domenick Porco in the Eastchester Town Court.
